1. Definition

In this terms of service;

1.1 The Creator refers to a person who created the original artwork, hereinafter referred to as the "Services".
1.2 The Client refers to a person or organization that uses the Services of the Creator in exchange for paying remuneration to the Creator
1.3 The Holder refers to a person or organization who has the right to possess the Creator’s artwork.

2. artwork rights

2.1 The Creator have full right over the artwork, including copyright; right to post the artwork with watermark on the social media, portfolio, promotion or any similar activities; and moral rights regarding the artwork.
2.2The Holder shall not claim the design or to make any misrepresentation either by action or omission that artwork as their own or as the Creator’s work.
2.3 The Holder shall not edit, trace, redraw, for any AI purpose or perform any wrongful acts contravening rights subject to clause 2.1, 2.2
2.4 The Holder shall not use the artwork for commercial purposes unless a commercial license has been granted.
2.5 In the case of a Non-Disclosure Agreement (NDA), the Client shall pay twice (×2) the net commission fee.
2.5 Credit for the artwork must be given to the Creator as: @Jia_Hui01.

3. commercial license

Status: CLOSE

3.1 The artwork rights mentioned in the above sections include usage in accordance with the terms of this section.
3.2 A commercial license requires an additional fee equal to three times (×3) the personal-use price.
3.3 A commercial license grants the right to use the artwork for commercial purposes, including the reproduction of multiple copies or files.
3.4 Any person using the artwork without a valid commercial license shall be in breach of this contract and shall pay five times (×5) the original price as a penalty without any notification by the Creator.

4. How to order

4.1 Requests must be sent via Direct Message (DM) or through VGen
4.2 References must be clear and in full color, including any extra items and props.
4.3 The Client must submit the order confirmation within 3 days upon reaching the queue.
4.4 No additional designs will be accepted beyond the details provided in the initial request.

5. PROCESS

5.1 A rough sketch will be sent within 1–3 days after receiving the request following clause 4. If there is a queue, the sketch will be sent after the previous work is completed.
5.2 During the sketch process, the Client has the right to adjust, change, or edit both minor and major details without any additional fee.
5.3 After the sketch is approved, the Creator will continue working once payment has been received. The payment process shall be subject to Clause 6. payment
5.4 Once the sketch has been approved, the Client can not request any further changes unless the Creator has made a mistake at the final work (e.g., missing minor details or incorrect elements based on the provided reference).
5.5 All requests are processed as non-urgent work.
5.6 The estimated production time is 1 week to 1 month. This period may vary depending on the complexity of the work.
5.7 A final work sends via Mail or Google drive (the artwork will deleted drive upload within 7 days)

6. payment

6.1 The Client shall pay the full amount within 3 days of receiving the payment request.
6.2 The payment method must be agreed upon by both parties. (PayPal, Wise, Vgen)
6.3 The payment currency shall be USD.

In this terms of service;

7.1 This agreement will be terminated under the following conditions without prior notice:

7.1.1 The deadline specified in clauses 4.3 or 6.1 has expired.
7.1.2 Cancellation is initiated by either party.
7.1.3 The Creator refuses the request for any reason.

7.3 Refunds are not available for any reason, except in cases where the cancellation is initiated by the Creator.
